The Government of Khyber Pakhtunkhwa, Finance Department (Regulation Wing) No. FD (PRC) 5-2/2002 Dated Peshawar the 30-3-2009 whereby the untrained teachers were given annual increments from their appointments but were deprived of their arrears should unite for their arrears which are their legal and Constitutional right.

            I wrote a letter to the Secretary to Government of Khyber Pakhtunkhwa, Law Department to conduct an enquiry that whether any consultation had been made prior to the issuance of the Notification under the Government Business Rules, 1985. Then I personally went to the Law Department and enquired about the record pertaining to the consultation but I was not shown any such record. The concerned persons told me that no such record exists about the Consultation regarding the issuance of the said Notification meaning thereby that no such consultation had been made for this Notification. The said second para of the Notification is repugnant to the numerous Judgments of the Supreme Court regarding the arrears when a person is declared/admitted entitled to the right of pay from a certain date in the past.

            Now, I have the intention to put the matter before Peshawar High Court through Writ Petition because I have no other alternative but to get justice from the High Court by striking down the illegal para from the Notification i.e. “No arrears shall, however, be admissible/payable prior to the date of issuance of this circular”

            I request all the teachers of Khyber Pakhtunkhwa through this message to unite themselves through their chosen persons to get their right through the High Court because there is no other choice but strike down the illegal part from the Notification through the Court. High Court is the only place where we can get our right.
