Subject:          Establishment of "Bright Future Welfare Organisation, Village Marghuz District Swabi, NWFP:

Respected Sir,

            It is submitted in your honour that the people of Mohalla Balar Khel in Village Marghuz District Swabi, NWFP Pakistan held a meeting on Sunday, 13 July 2008 in Village Marghuz and unanimously formed an Organisation named "Bright Future Welfare Organisation" for organising themselves for the solution of their problems faced by them, inside their village and relating to the Department of the Government. They approved the following Aims and Objectives, which will be amended later on until the final approval of the Constitution of the Organisation. The main purpose of the Organisation is to have a better working relationship with the Governmental and Non-Governmental Organisation for the uplift of the living standard of the people and their resolution of the grievances relating to the Government Departments and their Officials. The young generation will be encouraged to acquire knowledge and to prove better citizen of the Country.

Aims and Objectives.

(i)                 To promote the fraternal relations among the people by properly resolving their disputes among them by holding the meetings of the traditional Pukhtoons system of Jirga. If the aggressor is unwilling to accept the decision of the jirga and insists on persecution of the aggrieved person then to help the aggrieved person in the Court of Law by providing every kind of assistance in order to uphold the concept of supremacy of law and doing justice with the aggrieved person in letter and spirit.

(ii)               Women and Children are worst sufferers in every Country but in our Country, the situation is much alarming. Their names are either omitted from Record-of-Rights in the Land Revenue Department, or despite having their names in the Record-of-Rights of the Revenue Department, their shares are sold, mortgaged, exchanged and occupied illegally by their male relatives without their consent and in their absence by forgery and improper ways and most of the aggressors illegally dispossess female folk from their legal land property, and thus virtually their land property is usurped by their influential male relatives either in collaboration with the Revenue Officials or without the assistance of the officials. It will be the priority number one to safeguard the rights of all women who approach to the Organisation or the Organisation shall conduct survey in the village to find out the number of the women whose names have been omitted from the Record-of-Rights of the Revenue Department and shall ask the Authorities to enter the names omitted either advertently or inadvertently. If any woman or a child approached the Organisation for the resolution of land dispute, the Organisation shall endeavour on war footing for the retrieval of their rights and even monetary assistance shall be extended to them in the Court of law if they were found incapable to afford the expenses of the Court of Law.

(iii)             To promote the Educational activities in the area of operation, the Organisation shall acquire land for the construction of the Government Girls Primary School No. 3 Marghuz as it is at present functioning in a privately rented house where the girls and the staff is in deplorable condition. The said building does not meet the requirements of the teaching. The Organisation shall endeavour to find out ways and means to provide education to children especially girls at their doorsteps. In order to meet the requirements of other schools, the Headmistresses shall be requested to inform the Organisation from their problems so that to inform their high ups in the Education Department and the Government to fulfil the dream of quality education in the area. The Organisation shall ensure 100% enrolment of the children, especially girls, in the Government school by motivating their parents and removing their genuine grievances hindering in the way of Education of their children.

(iv)             To establish a standard library for the promotion of the reading habit in the youths and to provide them books in the English language on diverse topic for the acquisition of knowledge so that their skill in the use of English language is improved in order to acquire knowledge about any topic/subject in English language, to have communication with the rest of the World through Internet, print and electronic media by expressing themselves without any difficulty. This library would play a leading role in popularizing the English language among the people and in this way; they would prove themselves enlightened citizens of the State.

(v)               To keep the village clean from every kind of filth, observe "˜week of cleanliness' at specific interval so that to have clean and hygienic environment to ward off the chances of the deadly, diseases. For this purposes every person of the Organisation, without any exception, shall take part in the cleanliness campaign. In this connection, the funds available to the Union Council Marghuz shall be properly find out and their use shall be supervised.

(vi)             To ensure that every law enacted by the State is implemented in letter and spirit, the Organisation shall hold periodical meetings, conduct surveys and shall invite suggestions from the people regarding the laws relating to their rights in the Government Departments like Revenue Department, Police, Education, Local Government Department, Water and Power Development Authority, Communication and Works etc. The laws shall be cited to the concerned department for the effective implementation with sufficient reasonable opportunity to the department for the implementation and in case of failure to adopt all the peaceful and legal means to compel the concerned department or their officials to toe the line of the dictates of law enacted for the welfare of the people.

(vii)           To promote the sense of duty and responsibility, among the people to respect the laws of the State and to compel the officials of the State who are found defiant, inefficient or negligent to the laws, firm relations would be established with the Local, Provincial and Federal Government by holding meeting with the representatives of the people, Ministers of the Governments, High Officials of the Departments to effectively convey the demands of the people, suggestions for the improvement of the systems of Governments at various level because the main malady of the Country is non-interaction of the Governing Class and Governed Class. This non-interaction is the core issue of the present wave of Extremism and Terrorism, which has shaken the roots of the present structure of the Governance. In order to strengthen the writ of the Government, Bright Future Welfare Organisation would prove itself a helping hand with all those Government and Non-Government Organisations who work for the welfare of the people in any field.

(viii)         To forward the case of any Government Servant of any Government Department to his Competent Authority for the Departmental action, on the reception of the complaint of any aggrieved person. The Organisation shall fully pursue the case not only in the Department concerned, but also in the Court of law for proper prosecution of the official if it is found that he has committed any gross misconduct relating to his performance of duty, or has acted contrary to the laws of the Country, or has acted against the rules and regulations of his department. In this way not only the defiant, corrupt or negligent official shall be brought to book but also the aggrieved person would be restored to his original position and his grievance would be resolved through the process of law because the main aim of the Organisation is one side is to give relief to the people and on other side to improve the standard of governance in the Government Departments.

(ix)             The main grievance of the people at present time is from the officials of the Land Revenue Department. This is a proved fact that they do not perform their duty in the Union Council Marghuz, which is enjoined by the Para 3.17 subs. vide Correction Slip No. 3/87, Land Records Manual, dated 12-05-1987. Neither the Nazim Union Council Marghuz nor the District Nazim, District Coordinating Officer District and District Revenue Officer District Swabi took any action on the applications of Mr. Manzoor Ahmad B.Sc; L.L.B M.A. Political Science, Marghuz Balar Khel, District Swabi, NWFP. The Provisions of the above laws are still unimplemented and their unimplemented status has caused much inconvenience to the people and has given a free hand to the officials to violate the laws beneficial and to the welfare of the people which has led the situation to such extent that the people are of the view that the Government should establish its writ in its own Departments and bridle their maverick officers and officials instead of killing the people of their own Country either on one pretext or another. The Government should evaluate the performance of its own departments and also the conduct of its own officials instead of bombarding the people for being adverse and defiant to its Authority. People are of the view that Government, its administrative officials are responsible for the destruction of the peace, tranquillity, fraternity of the people by not doing properly following its own enacted laws by the Parliament. Is it not the violation of the Supremacy of the Parliament and the Constitution of Pakistan that its laws are not implemented in letter and spirit?

(x)               To establish cordial relations with the lawyer's community of the Country for including the voice of the Organisation in the voice of the lawyers for the Rule of Law, independence of Judiciary, speedy and inexpensive justice to the people especially in the lower Courts. People are of the opinion that the real success of the legal class is possible only when the lawyers assisted them in the Courts to their satisfaction. The Organisation shall act to promote the glorious image of the legal profession by bringing the aggrieved to the Courts for seeking the remedy of their grievances and in this way when they are properly treated by the lawyers, the people shall spontaneously become ally in their struggle for the targeted goals. Mere demonstrations, holdings protest processions and causing inconvenience to the people in the Courts by adjourning their hearings to the next dates would prove detrimental not only to their struggle but to their dignified image in the long run. People need speedy justice and when that is hindered, they are bound to form adverse opinion about the struggle of the Lawyers.

The people unanimously elected the undersigned as President of the Organisation and gave full authority to draft the Constitution and form the Cabinet. They assisted him financially and ensured him of more co-operations financially in future. The elders who spoke on the occasion were Mr. Nisar Mohammad Khan, Mr. Mohammad Abrar Member Union Council, Marghuz, Mr. Tahir Ahmad including the undersigned.

The Organisation shall be registered when it establishes its Head Office and the requirements in the office, start work and achieve success for showing the progress, raise more fund from the people through voluntary donations, grants etc. When all the particulars for the Registration are fulfilled, it shall submit the documents for the Registration and until the registration; it shall work and cooperate the people in the resolution of their disputes, grievances in the Departments of the Government. During their course of activities, the Organisation shall establish its relation with the Non-Governmental Organisation for doing Developmental Works in the village and in this way promising results would be achieved.

I hope that both the Governmental and Non-Governmental Organisations shall fully encourage the Young ones of Village Marghuz by extending full helping hand with it.
